In most cases, the answer to this question will be 'Yes'. The law protects business tenancies and most business leases can be renewed. However, we can refuse to renew your lease if you have broken the conditions of your lease, for example, if you have rent arrears or have not carried out necessary repairs.
Other situations where a new lease would not be available are if we plan to redevelop a property or we need the property for our own use. In these circumstances we would usually try to find you another suitable property.
If, when you agree a lease with us, we have a long-term intention to redevelop the property or use it for our own purposes, it is very likely that the lease will not have any renewal rights. (The lease will be excluded from Part II of the Landlord and Tenant Act 1954). We will make this clear to you when you negotiate the lease with our managing agents.
Before your current lease ends, our agents will contact you to discuss the terms of your new lease. There are time limits for lease renewals and we recommend that you get professional advice. If we cannot reach a suitable agreement, we will refer the negotiations to the county court who will decide a fair settlement.
